A. Session Fee & Payment

The Client agrees to pay the Photographer a non-refundable retainer fee of $250+tax at the time of booking to secure their appointment date and time. This non-refundable retainer fee includes the time and talent of the Photographer, basic retouching, and creative editing of images, as determined by the Photographer. The remaining session fee, as determined by the type of session, includes digital images. In the case of Seasonal Mini Sessions, the full amount of the session is due plus tax.

Digital images shall be selected and will be made available for download by the Client after full payment is received. Basic retouching of images includes light correction, color correction, and skin edits such as blemishes and bruises. Additional and extensive editing is available at additional expense to be determined by the Photographer.  Additional prints or digital images may be available for purchase.

B. Location Costs & Fees

If there are any costs or fees associated with the location the Client has chosen for their session, then the Client will be responsible for those fees. The Photographer will not guarantee or arrange payment on any location. The session fee covers travel within 30 minutes of zip code 77479 in Sugar Land, TX.   Any location outside of these limits will be subject to an additional charge of $50 per 30 minutes as part of the agreement.

C. Rescheduling & Cancellation

If an illness or situation prevents a photo session from taking place, the Client may reschedule their session at least 24 hours prior to their shoot without penalty. Should the Client fail to give 24 hours' notice, fails to show, or decide to completely cancel the shoot, the retainer fee is forfeited and will not be refunded. The Photographer reserves the right to reschedule due to illness, weather, equipment malfunction, or other circumstances beyond their control. The Photographer and the Client shall make every attempt to reschedule the session.

D. Re-shoots & Refunds

Re-shoots are determined at the discretion of the Photographer. In the event that the Client requests to reschedule a session, the retainer fee shall be applied to a new session if notice is given at least 24 hours prior to the scheduled session. Re-shoots and refunds will not be given for poor choices of clothing, make-up, hair, weather-related issues, bad behavior, or by not following the recommendations of the Photographer.

E. Completion Schedule

The Photographer shall make gallery proofs available through an online gallery proofing website within 10 days of the session. The Client is responsible for picking their favorite images from this gallery within 7 days from gallery delivery via email. The online gallery will stay open and active for 7 days from delivery via email. If the Client requests to extend the time or reopen the online proofing gallery, a $50.00 un-archival fee shall be applied. 

F. Archive

After 90 days from delivery of the final images, all images will be removed from the online gallery, the Client is responsible for downloading all images within this timeframe. The Photographer is not responsible for loss or damage to the digital files due to circumstances beyond the Photographer’s control. If the Client requests to extend the time or reopen the online final gallery, a $50.00 un-archival fee shall be applied. 

G. Payment

All payments are due in full unless payment arrangements have been made. Orders will not be processed until payment in full is received. If the Client has arranged a payment plan, the order will be placed after the final payment has been received.

H. Damage

If the client orders prints or products from their online gallery, the Photographer is not responsible for the damage of such portraits after delivery to the Client, including damage caused during transit by US mail. The Client assumes all responsibility for the safety of all portraits upon receipt.

I. Social Media

The Client may share web/blog post links and social media albums through the use of the share functions and dissemination of direct links. The Client shall identify the business name "Sweet Pecks Photography" in all captions of all photographs uploaded to social media websites and profiles. When uploading to Facebook, Instagram, or any other social media profile, the Client shall tag the location of the Photographer's business page (Sweet Pecks Photography) in the uploaded files. The Client understands that any alteration of original images is strictly prohibited, including, but not limited to the application of filters, cropping of watermarks, or modifications of any kind.

J. Session Requests

No cameras/camcorders/any type of recording device (this includes cell phone cameras) are allowed during the session unless a prior arrangement has been made between the Client and Photographer, including a written agreement. The Photographer will not continue if there are other cameras or video recordings during the session.

The session starts at the agreed-upon time. It is strongly encouraged that the Client arrives 15 minutes prior to the start of the session. This allows for any last-minute feeding, changing, and relaxing before the session begins.

Please do not bring any children not being photographed to the session.

Please make sure hair is combed and the face is clean and free of runny noses or eyes.

Please avoid eating or drinking red or orange food or drinks before the session, as red and orange tend to leave a stain on the face.

K. COVID-19 Guidelines and Other Liability

The Photographer is not responsible or will be held liable for any illness, including any COVID-19 related illness, that may occur during any session with the Photographer or at any point after the session. The Photographer, and those hired by Sweet Pecks Photography, will NOT meet for any session if she/they, or any person planning to attend the session, including client family and their guests:

a) Has experienced or is experiencing any cold or flu-like symptoms in the past 14 days (including fever of 100.4 or higher, chills, body aches, cough, sore throat, respiratory illness, difficulty breathing, or any other COVID-19 related symptom). 

b) Has been in contact with others who have experienced any cold or flu-like symptoms in the past 14 days (including fever of 100.4 or higher, chills, body aches, cough, sore throat, respiratory illness, difficulty breathing, or any other COVID-19 related symptom). 

c) Is currently diagnosed with COVID-19 or has a test pending for COVID-19.

d) Is currently under quarantine due to COVID-19 concerns.

e) Has been in contact with someone who tested positive for COVID-19 in the past 14 days.

It is the Client's/Photographer's responsibility to inform the Photographer/Client prior to the session if they have any COVID-19 symptoms or concerns.

The Photographer is not responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for their children and for themselves and release photographer from any claims against their person or their business.

L. Copyright & Penalty

Sweet Pecks Photography retains all copyrights to all images created during the Client’s session. A print release will be emailed when downloading digital files to print portraits for personal use up to designated size listed on print release. The print release does not allow publication of your portraits (i.e. entering in contests), selling, or altering of your images without the Photographer’s written permission. It is illegal to copy, scan, download, print, share, alter, or otherwise steal any image created by Sweet Pecks Photography during the Client’s photo session. This applies to "sneak peek" images, images posted in an online proofing gallery, blog, Facebook, or hard copy images. If the Client steals images via any method listed above, or any other method, the Client will be invoiced for the cost of EACH digital image client has stolen, at the Photographer’s current price per digital file.

Note from the Photographer: I work very hard to create images that reflect you and your family while keeping in line with my artistic vision and creativity. I know you will want to share them and I try to include a sneak-peek for that very reason. However, I ask that you simply link back to my website/Facebook page instead of right-clicking, saving, and sharing the image via your own page. I hope that you will respect not only my hard work, but the time, money, and dedication that I have put into training and equipment to capture these images for you.

Model Release (you can decline this Model Release below)

I hereby give to Sweet Pecks Photography the absolute and irrevocable right and permission with respect to the photographs that she has taken of myself and/or my minor child in which he/she may be included with others:

a) To copyright the same in the Photographer’s name or any other name that she may select.

b) To use, re-use, publish and re-publish the same in whole or in part, separately or in conjunction with other photographs, in any medium now or hereafter known, and for any purpose whatsoever, including (but not by way of limitation) illustration, promotion, advertising, and trade.

I hereby release and discharge the Photographer from all and any claims and demands ensuing from or in connection with the use of the photographs, including any and all claims for libel and invasion of privacy.
